Terms & Conditions for Commission Grace Huang
By agreeing to commission me, you automatically accept my Terms of Agreement that will be updated at any time. Please read these carefully and thoroughly!
General Information
- I reserve the right to decline any commission request.
- I reserve the right to adjust any information on my site, as well as the price of any commission accordingly.
- I will never change the amount of commission that has already been previously agreed upon, and the commissioner must pay the transaction fee for each payment and currency.
- I will not be responsible for any mistakes on the final version of any commission due to incorrect or missing information. It is the commissioner’s responsibility to provide all relevant information when requesting a commission.
- I reserve the right to reject critiques pertaining to artistic skill and stylization if the critique reduces the aesthetic quality of the piece.
- All communication between the commissioner and myself will be conducted and documented via email.
- All personal information will be kept private and confidential. Image Rights and Usage.
- I reserve full right to the image and its distribution and use unless otherwise specified.
- I reserve the right to display any commission image(s) on any of my websites or my portfolio.
- The commissioner must not claim my work as theirs.
- Under no circumstances may the commissioner use commissioned image(s) for commercial or profit purposes, including prints and redistribution of the commissioned image(s).
- The commissioner may only use artwork that was created specifically for them and is for the commissioner’s personal use only. This includes wallpapers, cropping the image for avatars/icons, printing the image for personal display, etc.
- Any license granted by me to the commissioner (or another party) to reproduce the work in any form should be paid for. This license may be needed either from myself or from my copyright agent.
- The commissioner is allowed to upload commissions I have created for them to an online gallery provided that the following link is always displayed with the commissioned work: www.gracehuang.art or www.gracehuang.co.
Refunds
Refunds must request by seven days, but keep in mind the following point:
- If the commissioner wishes to cancel a commission, the refunds must request by seven days once the deposit has paid, some fees may be applied, the refunded amount will be determined by how much work has been completed.
- The deposit for the commission is non-refundable after seven days.
- I reserve the right to cancel and refund a commission at any time, with prior notification to the commissioner, due to poor communication, rude/inappropriate behaviour, or any kind of abuse. The refund amount will be the balance after deducting the completed workload.
Commission Procedures
- I will not accept commissions without the best quality of image reference. In addition, please be thorough in describing what you want for your commission(s) in the early stage when you deposit the first payment. The more information you provide, the fewer questions I have to ask, the faster process!
- I will send the commissioner an image drawing from the canvas. Once the commissioner has approved in this stage, I will start colouring, send an image while processing, and an image for the finalised commission.
- The commissioner may not request to make changes to the commission once they have approved in the first drawing stage, otherwise, it will count as a redraw.
- A redraw of any type of commission will count as a separate commission and will be charged as such.
- Commission turnaround is generally a few months per commission, depending on my queue.
Freight & Delivery
- Any freight, delivery and insurance expenses for the commissioned painting should be pay by the commissioner.
- I will assist the commissioner in arranging a courier service; the commissioner will receive an email or a call from the courier service to confirm the delivery address and the payment, including insurance details in the end.
- The commissioner must check carefully once the commissioned painting has arrived. Once found any damages on the commissioned painting via transport, should be contacted the courier service immediately for the insurance claim.
Disputes
There is a need for appropriate dispute resolution mechanisms to address disputes that may arise over issues such as whether the commissioned work has been satisfactorily completed, who should bear the costs of changes to designs or to the work itself, differing expectations about completion, the inspection of the work prior to completion, and so on. The dispute resolution should be conducted by an independent mediator agreed to by both parties. The commissioner should meet the costs of the dispute resolution process.
